Please read these Terms carefully. By downloading, installing, or using the Wearwise app, you agree to be bound by them. If you do not agree, do not use the app.

## 1. About Wearwise
Wearwise is a personal wardrobe and outfit planning application ("the App"), operated by Annie Lummis ("we", "us", "our"), based in the United Kingdom.

## 2. Eligibility
You must be at least **13 years old** to use Wearwise. By using the App, you confirm that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission.

## 3. Your Account
- You must create an account to use Wearwise. You are responsible for keeping your login credentials secure.
- You must provide accurate information when registering.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at hello@wearwise.co.uk if you suspect unauthorised access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.

## 4. Free and Paid Features
### Free Tier
Wearwise offers a free tier with access to core features up to specified usage limits (which may change from time to time). Current limits are displayed within the app.
### Wearwise Pro
Wearwise Pro is a paid subscription that unlocks unlimited access to all features. Subscription terms:
- **Pricing** is displayed in the App and may vary by region. Prices include applicable VAT.
- **Billing** occurs monthly or annually depending on the plan you select, charged to your Apple App Store or Google Play account.
- **Free trial** — where a free trial is offered, you will not be charged until the trial period ends. You can cancel before the trial ends to avoid any charge.
- **Cancellation** — you may cancel your subscription at any time via your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you retain access to Pro features until then.
- **Refunds** — subscription fees are generally non-refundable except where required by law. For App Store purchases, Apple's standard refund policy applies. For Play Store purchases, Google's standard refund policy applies.
- **Price changes** — we will give you reasonable advance notice of any price change. Continued use after the change takes effect constitutes acceptance of the new price.
### Founding Member
Where we offer a Founding Member lifetime licence, this grants lifetime access to Wearwise Pro features as they exist at the time of purchase, and any features subsequently added to the Pro tier, for a one-time fee. This is a personal, non-transferable licence.

## 5. Acceptable Use
You agree not to use Wearwise to:
- Upload content that is illegal, offensive, defamatory, or infringes third-party rights.
- Attempt to access, reverse-engineer, or interfere with the App's code, servers, or infrastructure.
- Use automated tools (bots, scrapers) to access or extract data from the App.
- Attempt to circumvent any subscription limits or access controls.
- Impersonate any person or entity.
- Violate any applicable law or regulation.
We reserve the right to remove content or suspend accounts that violate these rules.

## 6. Your Content
You retain ownership of all content you upload to Wearwise (photos, wardrobe items, outfits, etc.).
By uploading content, you grant us a **limited, non-exclusive, royalty-free licence** to store and display that content within the App solely for the purpose of providing the service to you. We do not claim ownership of your content, and we do not use your content for any other purpose without your explicit consent.
You are responsible for ensuring you have the right to upload any content you add to the App (e.g. photos you did not take yourself).

## 7. AI-Generated Content
Outfit suggestions and style advice generated by the AI features are for informational and personal styling purposes only. They do not constitute professional fashion, retail, or financial advice. AI-generated content may occasionally be inaccurate or unsuitable — use your own judgement.

## 8. Intellectual Property
All content within Wearwise that is not your personal content — including the app design, code, graphics, logos, text, and AI models — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works of any part of the App without our prior written consent.

## 9. Third-Party Services
Wearwise uses third-party services including Clerk (authentication), Anthropic (AI features), and Open-Meteo (weather data). Your use of these services via Wearwise is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
The App may contain links to external websites. We are not responsible for the content or practices of those sites.

## 10. Availability and Changes
We aim to keep Wearwise available and running smoothly, but we do not guarantee uninterrupted access. We may:
- Update, modify, or discontinue features with reasonable notice.
- Perform maintenance that temporarily affects availability.
- Change the features included in the free tier or Pro tier, with notice to existing subscribers.
If we discontinue Wearwise entirely, we will provide at least **30 days' notice** and offer a pro-rata refund for any unused paid subscription period.

## 11. Disclaimer of Warranties
Wearwise is provided **"as is"** and **"as available"** without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that:
- The App will be error-free or uninterrupted.
- AI suggestions will be accurate or suitable for your needs.
- Any defects will be corrected.
Nothing in these Terms excludes or limits liability that cannot be excluded by law (including liability for death or personal injury caused by negligence, or for fraud).

## 12. Limitation of Liability
To the fullest extent permitted by law:
- Our total liability to you for any claim arising from your use of Wearwise shall not exceed the greater of: (a) the amount you paid for your subscription in the **12 months prior** to the claim, or (b) **£50**.
- We are not liable for any indirect, incidental, consequential, or special damages, loss of data, or loss of profits, even if we have been advised of the possibility of such damages.
If you are a consumer in the UK, nothing in these Terms affects your statutory rights under UK consumer protection law.

## 13. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or costs (including reasonable legal fees) arising from: (a) your use of the App in violation of these Terms; (b) content you upload that infringes a third party's rights; or (c) your violation of any applicable law.

## 14. Termination
**By you:** You may stop using Wearwise at any time and delete your account within the app settings or by contacting hello@wearwise.co.uk.
**By us:** We may suspend or terminate your account immediately if you breach these Terms, or on reasonable notice for any other reason. If we terminate your account without cause, we will refund any unused pro-rata subscription fees.
On termination, your right to use the App ceases. Sections 6, 8, 11, 12, 13, and 15 survive termination.

## 15. Governing Law and Disputes
These Terms are governed by the laws of **England and Wales**. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.
If you have a complaint, please contact us at hello@wearwise.co.uk first. We will do our best to resolve it. If we cannot, you may be entitled to use an alternative dispute resolution scheme — we will advise you of applicable options at that time.

## 16. Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you via the app or by email at least **14 days** before the change takes effect. Continued use of the App after that date constitutes acceptance of the new Terms. If you do not accept the updated Terms, you should stop using the App and may request a refund for any unused subscription period.

## 17. General
- **Entire agreement** — these Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Wearwise.
- **Severability** — if any provision is found unenforceable, the remaining provisions continue in full force.
- **No waiver** — failure to enforce any right does not constitute a waiver of that right.
- **Assignment** — you may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition, or sale of assets, with notice to you.
